Must I file a claim within a certain length of time?

In Oregon you generally must file a lawsuit within two years of the malpractice or of the date you discovered the malpractice. However, many types of malpractice have a longer claim period. These include:

  • death caused by malpractice
  • fraud or concealment of malpractice
  • defective medical equipment or unsafe medications
  • malpractice involving minors

Sometimes there is a shorter time period. In some cases you must give notice of your intent to file a claim within 180 days.
