How to Obtain Oregon Medical Malpractice Claims Information

Once an Oregon medical malpractice attorney proves that your doctor acted negligently and that you were injured as a result of that negligence, this information is forwarded to the Oregon Medical Board. The Oregon Medical Board will compile this information, in conjunction with information they receive from primary insurers, doctors, public agents, and other health officials, into an official medical malpractice claim report.

Since all claim reports and disclosure requirements are governed by ORS 742.400, the Oregon Medical Malpractice Database is public record. Under Oregon law, you can find medical malpractice suits filed against your primary care provider, physician, or specialist. For a fee of $10, the Board of Medical Examiners will provide a doctor’s disciplinary record or malpractice report. Typically, the board of investigators will look into:

  • Claims that involve a payment of $100,000 or more
  • Multiple claims against a single doctor
  • Extraordinarily large claims

When viewing the database, there are a few things you should keep in mind. While payment for a malpractice claim may look suspicious, payments can occur for a variety of reasons that don’t necessarily reflect on the physician’s competence. While a listing in the database doesn’t necessarily mean an instance of malpractice occurred, it’s a good indication that you should seek more information from your doctor or from the Oregon Medical Board.
